In pursuant to order dated 22.03.2023, bail bonds of appellant Brij Mohan were forfeited and warrant of arrest was issued against him. After arrest he was produced before Hon’ble Vacation Judge on 13.06.2023, wherein a direction was given to taken him to custody and send him to concerned jail. Now appellant Brij Mohan is produced before this Court.

Present bail application is filed on behalf of Brij Mohan.

Heard learned counsel for appellant and learned Public Prosecutor.

It is further submitted that appellant Brij Mohan is not having any surety to file on behalf of Brij Mohan.

Learned counsel for appellant is ready to argue the matter on next date and he will not seek any adjournment for arguments.

Having considered his submission and also that appellant is now serious for appearance in pending appeal, therefore order dated 22.03.2023 is hereby recalled and ordered that appellant be released henceforth and he will continue to remain on bail bonds submitted in pursuant to order of suspension of sentence dated 22.09.1995. The proceedings initiated under Section 446 Cr.P.C. is also dropped.

Office is directed to recall proceedings from learned trial court and also tag the same with the file. Office is directed to mark his presence and issue order of release immediately.
