Heard learned counsel for the parties on the application for temporary suspension of sentence.

This application for temporary suspension of sentence is preferred on behalf of the applicant for suspending his sentence temporarily for a period of 15 days on account of death of his real father-in-law Surajmal Jat on 02.02.2023.

Learned Public Prosecutor has submitted the factual report, wherein the factum of death of Surajmal Jat has been verified by the police.

Learned counsel for the applicant has submitted that earlier, the applicant was granted parole and after availing the same, the applicant has surrendered before the concerned jail authorities in

time without violating any condition of the parole.

Having heard learned counsel for the parties and taking into consideration the overall facts and circumstances of the case, this application for temporary suspension of sentence is allowed and it is hereby directed that the sentence awarded to applicant - Suresh Kumar S/o Sh. Chhagan Lal Jat by the Addl. Sessions Judge No.1, Udaipur (for short ‘the trial court’) shall remain suspended for a period of ten days from the date of his actual release subject to the condition that he shall furnish a personal bond to the tune of Rs.50,000/- along with two verified sureties of the likewise amount to the satisfaction of the trial court.

The trial court shall give a date for surrender to the applicant - Suresh Kumar S/o Sh. Chhagan Lal Jat.

The applicant - Suresh Kumar S/o Sh. Chhagan Lal Jat shall surrender before the concerned jail authorities positively after expiry of the period of temporary suspension of sentence.
