The instant special appeal writ has been filed by the appellant-institution against the action of the respondents of cancellation of No Objection Certificate issued in favour of it as well as against the order dated 28.03.2023 passed by the learned Single Judge, whereby it has been dismissed the writ petition being S.B. Civil Writ Petition No.10855/2022 (Indira Gandhi Memorial Collage Jakharanwali Vs. State of Rajasthan & Ors.) filed by the appellant-institution while observing that despite providing several opportunities to the appellant-institution for removing the

deficiencies pointed out by the respondents, the appellantinstitution failed to cure the same.

Learned counsel for the appellant-institution has failed to convince this Court that before issuance of cancellation order, the appellant-institution had cured the deficiencies pointed out by the respondents.

In such circumstances, we do not find any merit in this special appeal writ, therefore, no interference is called for. 4. At this stage, learned counsel for the appellant-institution prays that appellant-institution be granted liberty to move fresh application before the respondents for grant of No Objection Certificate.

It is noticed that the learned Single Judge in the impugned order dated 28.03.2023 has already observed that if the deficiencies pointed out by the respondents are again informed to the appellant-institution and the appellant-institution is able to cure the same, it shall be open for the respondents to pass fresh order regarding grant of No Objection Certificate prospectively only, strictly in accordance with law.

Consequently, with these observations, the instant special appeal writ is dismissed.

All the pending applications also stand dismissed.
