Heard learned counsel for the petitioner.

An application (01/23) has been filed by the petitioner for impleading the Joint Director (School Education) Jodhpur cum Appellate Authority, Jodhpur as party respondent in the matter.

For the reasons mentioned in the application, the same is allowed. The Joint Director (School Education) Jodhpur Cum Appellate Authority, Jodhpur is impleaded as party respondent No.5. Amended cause title already filed is taken on record.

Heard learned counsel for the petitioner.

Learned counsel for the petitioner submits that the petitioner was working as Lower Division Clerk in the respondent Department and he has been awarded the punishment of removal of service after holding the disciplinary enquiry against him. Learned counsel further submits that against the order of removal dated 19.04.2023, the petitioner has preferred an appeal before the respondent No.5 and the same is pending consideration since May, 2023. Learned counsel, instead of pressing the present writ petition on merit, submits that the petitioner will be satisfied if the respondent No.5 - the Joint Director (School Education) Jodhpur cum Appellate Authority, Jodhpur is directed to decide his pending appeal expeditiously.

Considering the limited prayer of the petitioner, the present writ petition is disposed of with a direction to the respondent No.5 - the Joint Director (School Education) Jodhpur cum Appellate Authority, Jodhpur to decide the pending appeal of the petitioner expeditiously preferably within a period of two months from the date of receipt of certified copy of this order strictly in accordance with law.
