“These matters come up for consideration of application No.1/2023 filed on behalf of the State with a prayer for dismissal of the writ petitions on the ground that since all the petitioners are having separate cause of action, a joint writ petition is not maintainable.
Mr. M.S. Singhvi, learned Advocate General has submitted that this Court in D.B. Civil Writ Petition No.2659/2021 decided on 18.03.2021 has already taken a view that if the petitioners are having separate cause of action, a joint writ petition is not liable to be entertained on behalf of all the petitioners. It is further submitted that this Court while dismissing the aforesaid writ petition has granted opportunity to the petitioners to file fresh writ petition individually. Having heard learned counsel for the parties and taking into consideration the fact that all the petitioners are having separate cause of action, we are not inclined to entertain these joint writ petitions preferred by them. Resultantly, the application No.1/2023 filed on behalf of the State is allowed and the instant writ petitions are dismissed. However, the petitioners are at liberty to file fresh writ petition individually, if so advised.
