The petitioner has prayed that the respondents be directed to consider her case for promotion to the post of Jail Mukhya Prahri for the year 2018-19.

The reason for which the petitioner was not being considered for promotion was that she had given birth to third child after 01.06.2002.

An interim order was passed by a Co-ordinate Bench of this Court on 29.06.2020 and the petitioner’s candidature was ordered to be provisionally considered.

The provisions relating to restriction on Government Servant for his/her joining/promotion on the birth of third child after 01.06.2002, has undergone changes and accordingly impediment of getting promotion on account of third child has been done away with completely.

It is informed by Mr. Bissa, learned counsel for the State that petitioner’s case is being considered in light of the notification dated 16.03.2023 and the circular dated 24.05.2023, issued by the State Government in this regard.

The petition is thus, disposed of with a direction to the State to consider petitioner’s case in light of the notification dated 16.03.2023 and the circular dated 24.05.2023 within a period of three months from today.

The stay application also stands disposed of accordingly.
