The petitioner has preferred the present writ petition claiming the following reliefs :-

"(i) The record of the case may kindly be called for:

(ii) The order/communication dated 13.02.2023 may be quashed and set aside.

¶15

(ii) The respondent university may be directed to include the petitioner institution in the list of eligible institutions for undertaking D. Pharma Course for academic session 2022-23 onwards.

(iv) The respondent authorities may further be directed to include the candidature of the petitioner institution in the process of counseling for D. Pharma Course in academic session 2022-23 and onwards.

(V) Any other consequential order/decision taken by the respondent university pursuant to the order dated 13.02.2023 may kindly be taken on record and may be quashed and set aside.

(vi) That without prejudice and in alternative the respondent university may kindly be directed to adjust

the fees deposited by the petitioner institution for academic session 2022-23 for subsequent academic session without any penalty/late fees.

(vii) Cost of litigation and damages may also be allowed in favour of the petitioner.

(viii) Any other appropriate writ or order or direction which is favorable to the petitioner in the facts and circumstances of the case may kindly be granted to the petitioner."

At the outset, learned counsel for the respondent submits that if the petitioner-institution deposits the difference of amount in the fee then they shall permit them to carry forward the fee deposited in the last academic session, which could not materialize, shall be carried forward for the next session and the petitioner-institution shall on that condition be permitted for counseling for the academic session 2023-24 for D. Pharma Course.

Learned counsel for the petitioner is agreeable to the disposal on the same terms.

In view of above, the present petition is disposed of with a direction to the respondent to abide by the assurance and submission given by learned counsel for the respondent in the Court strictly in accordance with law.

All pending applications also stand disposed of.
