Counsel for the State-respondents submitted that the benefit of first, second and third selection scale was granted to the petitioner on completion of 9, 18 and 27 years of service i.e. on 25.02.1992, 05.11.1995 and 05.11.2004 respectively. Counsel further submitted that on asking of the Court, an additional affidavit has been submitted in this regard on 04.10.2023 which .indicates that the aforesaid benefits have been granted to the petitioner on the above noted dates. The affidavit submitted by the respondents further indicates that the pay-scale of petitioner No. 1 was fixed under the pay-scale of Rs. 1400-2600 and the same was wrongly fixed subsequently it was corrected tb the scale of Rs.1200-2050 and excess amount was recovered vide order dated 25.04.2016. Counsel submits that by doing so, a sum of Rs.34,317/was recovered and the balance amount of Rs. 1,38,529/was returned to the petitioner. Counsel submitted that under these circumstances, the grievance raised by the petitioner has been redressed and now no further cause of action survives to continue this petition.
