Instant petition has been filed by the petitioner with the

following prayer:

“i) issue an appropriate writ, order or direction in the nature thereof thereby, the respondents be directed to relieve the petitioner from the present place of posting i.e. Patwar Mandal Sailwara, Tehsil Reodar, District Sirohi in compliance of 21.09.2019 issued by the higher authority respondent no.2 on the post of Patwari.

ii) Issue an appropriate writ, order or direction in the nature thereof thereby, the respondent be directed to allow the petitioner to join at District Sikar in compliance of the transfer order dated 21.09.2019, after relieving the petitioner. Iii) Issue an appropriate writ, order or direction in the nature thereof thereby, the action of the respondents be declared illegal whereby they are not relieving the petitioner from the present place

of posting in compliance of the transfer order dated 21.09.2019.

iv) Issue an appropriate writ, order or direction in the nature thereof thereby, the respondents be further directed not to withdraw/cancel the transfer order dated 21.09.2019 qua the petitioner.

v) Pass any other appropriate order which this Hon’ble Court may deem fit, just and proper in the facts and circumstances of the case in favour of the petitioner.

vi) Cost of the writ petition be awarded in favour of the petitioner.”

Contents of the petition indicates that by way of filing instant petition, the petitioner is seeking directions against the respondents to relieve him to join the transferred place of posting pursuant to the order dated 21.09.2019. Counsel submits that inspite of passing of considerable time till date no relieving orders have been passed for reasons best known to the respondents. Counsel submits that the respondents be directed to pass appropriate orders in compliance of the order dated 21.09.2019.

Instant petition stands disposed of with directions to pass appropriate order for relieving of the petitioner to join the transferred place of posting within a period of one month from the date of receipt of certified copy of this order.

Stay application and all pending applications, if any, also stand disposed of.

However, the respondents would be at liberty to move application for recalling of this order in case any adverse situation is found.
