Heard learned counsel for the parties.

Learned counsel for the petitioners submits that the controversy involved in the present case is squarely covered by a judgment rendered by this Court in batch of writ petitions led by S.B. Civil Writ Petition No. 483/2023 (Hitesh Kumar & Ors.

vs. State of Rajasthan & Ors), decided on 19.07.2023 .

Learned counsel for the petitioners, instead of pressing the present writ petition on merit, submits that the petitioners may be given liberty to file a detailed representation to the respondent No.2.- The Mission Director (NMM), Directorate of Medical Health and Family Welfare Services, Swasthya Bhawan, C-Scheme, Tilak Marg, Jaipur and he may be directed to decide the same expeditiously.

Considering the limited prayer made by learned counsel for the petitioners, the present writ petition is disposed of with liberty to the petitioners to file a detailed representation to the respondent No.2- the Mission Director (NMM), Directorate of Medical Health and Family Welfare Services, Swasthya Bhawan, C- Scheme, Tilak Marg, Jaipur within a period of two weeks along with copy of judgment rendered by this Court in case of Hitesh Kumar (supra) . In the event of filing such representation, the respondent No.2-the Mission Director (NMM), Directorate of Medical Health and Family Welfare Services, Swasthya Bhawan, C- Scheme, Tilak Marg, Jaipur shall consider and decide the same at the earliest preferably within a period of two weeks from the date of receipt of such representation strictly in accordance with law keeping in mind the law laid down by this Court in the case of Hitesh Kumar (supra) .
