In S.B. Civil Writ Petition No. 11514/2022:

Mr. R.D. Bhadu, learned Dy. Govt. Counsel appearing on behalf of respondents-State assures the Court that necessary measurement shall be conducted by the respondents within a period of three months from today.

In light of such assurance given by Mr. Bhadu, the present petition is disposed of while directing the respondents to make the necessary measurement as sought by the petitioner within a period of three months from the date of receipt of certified copy of this order, strictly in accordance with law. It is made clear that any measurement made, shall not impact the ongoing work of NHAI. In case, any dispute remains, the parties shall be free to come back to the Court. All pending applications stand disposed of.

In S.B. Civil Writ Petition No. 1995/2022:

The prayer clause (a) of the writ petition reads as follows:

“a) by an appropriate writ, order or directions the respondents may be directed to pay compensation alongwith interest @ 18% p.a. against acquired land of the petitioner in Khasra No.951/94 out of 2 Bigha 10 Biswas.”

The prayer is not disputed by the Mr. Vinit Sanadhya, learned counsel appearing on behalf of respondent-NHAI and he submits that the respondent-NHAI is already offering compensation for the claimed 2 Bigha 10 Biswa land of the petitioner, and thus, the dispute is longer surviving.

In view of the above, the present petition is disposed of with a liberty to the petitioner to seek such compensation, which is being offered by NHAI for Khasra No.951/94 for 2 Bigha 10 Biswa land as claimed in the petition. All pending applications stand disposed of.
