This writ petition under Article 226 of the Constitution of India has been preferred claiming the following reliefs:

“An appropriate writ order or direction directing/quashing the email/impugned order dated 27.12.2021 (Annex.13) passed by the respondent No.3 by which candidature of the petitioners was cancelled and further not to allot the RO

Dealership of Village Nathwana, Tehsil Lunkaransar, District Bikaner to any other person.

An appropriate writ order or direction directing the Respondents to allot the RO Dealership of Village Nathwana, Tehsil Lunkaransar, Distt. Bikaner to Petitioners and in pursuance of that purpose issue appropriate orders/letters.

An appropriate writ order or direction directing the Respondents to issue the appropriate orders/letters instructing to Petitioners to deposit the ISD amount with documents within a period as decided by this Hon’ble High Court, which may be deemed just and proper in the facts and circumstances of the present case.”

The petitioners were declared qualified for the draw of lots for RO dealership, they were required to be remain present personally on 02.03.2021 with the requisites.

Despite being repeatedly called, the petitioners did not submit the security deposit and the specified documents; repeated reminders were issued. It is an accepted position that the petitioners did not submit the required security deposit and the specified documents before the required date that was 06.12.2021. The petitioners’ disqualification for the retail outlet is justified.

In view of the above, no interference in the present petition is called for and the same is accordingly dismissed.
