Learned counsel for the parties submit that the issue raised in the present writ petitions is squarely covered by order in Naresh Kumar Sharma v. State of Rajasthan & Ors.: S.B. Civil Writ Petition No.17747/2022, decided today i.e. on 2.12.2022 and, therefore, petitioners are also entitled to similar relief.

Learned counsel for the respondents does not dispute the said submission.

In the case of Naresh Kumar Sharma (supra), this Court inter alia came to the following conclusion:-

“I have considered the submissions made by learned counsel for the parties and have perused the material available on record.

The very fact that the petitioner was called for document verification in the first round i.e. by notice dated 11.10.2022 shows that the petitioner is higher in merit in the wait listed candidates.

Though, for non appearance at the time of document verification, the petitioner has no right to seek inclusion in subsequent document verification, in case, the respondents are to hold further document verification on account of seats in petitioner’s category remaining vacant and petitioner admittedly being higher in merit, there appears to be no issue for the respondents in permitting the petitioner to participate in the document verification and, in case, he is eligible, to accord him appointment.

In view thereof, the petition filed by the petitioner is disposed of.

It is directed that, in case, the respondents hold fresh round of document verification on account of any post remaining vacant in petitioner’s category, the petitioner may be permitted to participate in the document verification and if he is otherwise found eligible and is in merit, to accord him appointment in accordance with law.”

In view of the submissions made, the petition filed by the petitioner is disposed of with similar directions as given in the case of Naresh Kumar Sharma (supra).
