Learned counsel for the petitioner submits that the controversy involved in the present matter pertains to the violation of principles of natural justice.

Learned counsel for the petitioner also submits that the petitioner may be permitted to appear before the concerned authority-respondent No.2 District Collector, Ajmer, who may be directed to afford opportunity of hearing to the petitioner and decide the case after observing the principles of natural of justice.

Learned counsel appearing for the respondents has not refuted the same and conceded that proper opportunity of hearing could not be granted to the petitioner but instead of keeping the matter pending, the respondent No.2 be permitted to pass fresh order.

In view of the aforesaid submission and considering that the impugned order dated 22.09.2023 (Annexure-5) qua the petitioner has been passed without affording reasonable opportunity of hearing and hence, the same is quashed and set aside.

The order dated 22.09.2023 (Annexure-5) passed by the District Collector, Ajmer, qua the petitioner, is quashed and set aside on the ground that the same has been passed without affording proper opportunity of hearing to the petitioner.

The writ petition is accordingly allowed.

The petitioner shall appear before the concerned District Collector on 16.11.2023 and file his reply. The respondent No.2 District Collector shall consider the reply of the petitioner and provide proper and reasonable opportunity of hearing to the petitioner and decide the case while adhering to the principles of natural justice, strictly in accordance with law.

Stay petition and all pending applications, if any, stand disposed of.
