The petitioner has preferred the present writ petition claiming the following reliefs :-

"a) by an appropriate writ, order or direction the writ petition filed by the petitioner may kindly be allowed. b) by an appropriate writ, order or direction, the impugned action on the part of the respondent authorities in not complying with the directions issued by the Hon'ble Apex Court in the case of Nihila P.P. (supra) in its true letter and spirit and thereby, not

adhering to the modified scheme for conducting NEET (UG) & (PG) framed by the DGHS, may kindly be declared illegal and accordingly, be quashed and set aside.

c) by an appropriate writ, order or direction, the respondent authorities may kindly be directed to allot a government seat to the petitioner in the affiliated Government Medical College as per her merit in the Special Stray Vacancy Round forthwith or in the alternative, she may be permitted to move from Management Seat to Government Seat in the allotted RUHS CMS Government Medical College, Jaipur forthwith.

d) Any other appropriate order, which this Hon'ble Court deems just and proper in the facts and circumstances of the case may kindly be passed in favour of the petitioner."

Mr. Mukesh Rajpurohit, learned Dy. S.G. on behalf of the contesting respondent-National Medical Commission, at the outset, submits that as a special case, though the petitioner cannot be transferred to Government Medical College in midsession or in the government seat of RUHS CMS Government Medical College, Jaipur, but she is allowed to deposit fee under Government seat quota instead of paying fee as per management quota.

Learned counsel for the petitioner submits that the petitioner is satisfied with the aforesaid proposition of the counsel for the respondents and undertakes to deposit the fee accordingly.

On such submission, the present petition is disposed of with a direction to the respondents to abide by the submission made by learned counsel for the respondent in the Court.
