The present transfer petition has been preferred on behalf of the petitioner-wife with the prayer for transferring Civil Case No.385/2019 filed under Section 13(1)(ia) and Section 13(1)(ib) of the Hindu Marriage Act, 1955 (for short hereinafter referred to as, ‘the Act of 1955’) from Family Court No.3, District Bikaner to the Family Court, Jaipur.

Learned counsel Mr. Shaurya Pratap Singh puts in appearance on behalf of the respondent and submits that he has no objection, if the present petition is allowed and the matter is transferred to Family Court, Jaipur.

In view of the specific consent given by learned counsel for the respondent, the present transfer petition is allowed. The Civil Case No.385/2019 pending before Family Court No.3, Bikaner is directed to be transferred to Family Court, Jaipur.

The Family Court No.3, Bikaner is directed to send the complete file/record of Civil Case No.385/2019 (Anshuman Singh Shekhawat vs. Seema Kanwar) to the Family Court, Jaipur within a period of two weeks from the receipt of the copy of the present order. It is made clear that after the transfer of the said petition to the learned Family Court, Jaipur it would proceed in accordance with law.

Let a copy of the present order be sent forthwith to the both the Family Court, Jaipur and Family Court No.3, Bikaner.

The stay petition stands disposed of.
