Matter comes up on an application (IA No.1/2023) filed by the appellant under Section 151 read with Order 23 Rule 3 CPC for taking the compromise dated 02.01.2023 on record and for disposal of appeal on the basis of compromise.
Learned counsel for both the parties jointly submit that a compromise has been arrived at between the parties. So, appeal be disposed of on the basis of compromise dated 02.01.2023.

They have submitted that the compromise dated 02.01.2023 duly signed by the parties, which is taken on record.
The parties are also present in person before this court. They have put their signatures on the court’s ordersheet and they have been identified by their respective advocates.
In view of the above, the present civil second appeal stands disposed of on the basis of compromise. The compromise dated 02.01.2023 shall be treated as an integral part of this order. The judgment passed by the court below is modified to the aforesaid extent. Decree be drawn accordingly.
