The matter comes upon an application preferred on behalf of the appellant for withdrawal of the present appeal. It has been submitted in the application that the appellant Municipal Council, in its meeting dated 05.12.2022, took a resolution to withdraw the present appeal and therefore, the present application has been preferred.
In view of the submission made, the application is allowed. The appellant is permitted to withdraw the present appeal and therefore, the same is dismissed as withdrawn.
The stay petition also stands dismissed.
