Today the matter comes up for hearing.

The petitioner present in person would undertake that after having joined his duty, he will perform his duties in the school where he has been now posted.

Learned counsel for the respondents submits that in compliance of the order passed by this Court on 20.04.2023, the authorities have initiated disciplinary action.

The petitioner at this stage seeks indulgence of this Court to submit that in view of the undertaking which is now being given by him, a liberal view may be adopted.

¶35

We may only say that the petitioner being a teacher, is supposed to discharge his duties and functions without any delay.

¶36

If the petitioner starts taking classes and performs his duties as a teacher, even if any disciplinary action has been initiated, the respondent-Authority may consider this aspect as mitigating circumstance.

Accordingly, the miscellaneous application stands disposed of.
