Petitioner has preferred this Criminal Writ Petition (Parole) with a limited prayer for waiving the condition of furnishing two attested sureties, on the ground that financial condition of the petitioner is very weak.

It is contended by counsel for the petitioner that petitioner was allowed to be released on permanent parole by the Deputy Secretary, Department Of Home (Group-12), Government Of

Rajasthan, Government Secretariat, Jaipur, upon furnishing a personal bond of Rs.50,000/- with two sureties of Rs.50,000/each. As he was not in a position to furnish sureties imposed by the Department, he could not be released on permanent parole.

Report was sought from the learned State Counsel with regard to financial status of the petitioner. A report has been received from the Superintendent of Police, District Jhalawar (Raj.). From perusal of the same, it is revealed that financial condition of the petitioner is not good. 4. We have considered the contentions and have perused the order dated 23.05.2022. 5. From perusal of the order dated 23.05.2022, it is evident that petitioner was granted parole on furnishing a personal bond of Rs.50,000/- and two sureties of Rs.50,000/- each. He has not availed the benefit of parole, as he could not arrange for the sureties, as financial condition of the petitioner is very weak. As per the financial status report also, it is established that the financial condition of the petitioner is not good.

Since, parole application filed by the petitioner has been allowed and the only prayer of petitioner is to waive the condition imposed by the Department with regard to furnishing of two sureties, this Court deems it proper to dispose of the present criminal writ petition (parole) and modify the order dated 23.05.2022, qua the present petitioner.

Consequently, the present Criminal Writ Petition (Parole) is disposed of and the order dated 23.05.2022 passed by the Department qua the present petitioner is modified to the extent that he shall be released on permanent parole on furnishing of
