The instant misc. petition under Section 482 Cr.P.C. has been filed by the petitioner-victim Amra Ram Rinwa with the prayer that the Investigating Agency may be directed to conduct fair and impartial investigation in F.I.R. No.94/2023, registered at Police Station Degana, District Nagaur for the offences under Sections 143, 341 and 382 IPC.

Heard learned counsel for the petitioner as well as learned Public Prosecutor.

A perusal of the FIR filed by complainant Kishore Bainda (son-in-law of the petitioner-victim) reveals that the accused persons had assaulted the victim-petitioner and looted a sum of Rs.17,200/- and a mobile phone from him.

A cursory look at the FIR discloses commission of cognizable offences.

A coordinate Bench of this Court vide order dated 07.08.2023, directed the Investigating Officer to investigate the matter thoroughly and submit the factual report. In compliance of the order dated 07.08.2023, a factual report dated 28.08.2023 has been received from the office of the Circle Officer, Merta City which reveals that the investigating agency has conducted thorough investigation into the matter and found the offences under Sections 341, 323 and 325 IPC to be proved against the accused persons Jagdish, Suresh and Mahendra Dhayal, however, the offences under Sections 143 and 382 have not been found to be proved against them. So far as accused Jetharam is concerned, he was not found involved in commission of alleged crime.

A perusal of the factual report reveals that the investigating agency has conducted thorough investigation and thus, no interference is warranted in this misc. petition by this Court in exercise of powers under Section 482 Cr.P.C., at this stage.

Thus, the misc. petition as well as stay application are dismissed.

¶25

However, the victim-petitioner shall be at liberty to take up legal recourse before the competent authority, if need arises, in accordance with law.
