The present criminal misc. petition under Section 482 Cr.P.C. has been filed by the petitioners seeking quashing of FIR No.1229/2019 registered at Police Station Jawahar Circle, Jaipur for the offences under Sections 406, 420 and 120-B IPC and all subsequent proceedings, arising out therefrom against the petitioners on account of compromise entered in between the parties.

From perusal of the FIR it is apparent that the transaction between the petitioners and complainant is pertaining to a land in question. According to the contents of the FIR an agreement to sale was executed on 11.04.2016 and Rs. 10,00,000/- were paid to the accused in lieu of promise to sale the land. It seems from the contents of FIR that the transaction between the parties is purely a civil matter. Further the petitioners and respondent have entered into an agreement, which states that Rs. 10,00,000/taken by the petitioners from the respondent has been returned. It is further to be stated that FIR was lodged under Sections 420, 406 and 120-B IPC. Section 420 IPC is compoundable offence.

Looking to the facts that petitioners and respondent No.2 have settled their dispute, therefore, the present criminal misc. petition is allowed and the FIR No.1229/2019 registered at Police Station Jawahar Circle, Jaipur and all subsequent proceedings, arising out therefrom against the petitioners, are quashed on account of the compromise entered in between the parties.
