Instant bail application has been filed by petitioner under Section 439 Cr.P.C. in connection with FIR No.469/2022 registered at Police Station- Chaksu, District- Jaipur city (South) for offences under Sections 363, 366-A, 376(2)(I) of IPC and 3/4, 5(L)/6 of POCSO Act, 2012.

Counsel for petitioner argued that petitioner has wrongly been implicated in the present case the prosecutrix is of above 16 years, in her statements recorded under Section 164 Cr.P.C., she states to went with petitioner voluntarily, the petitioner is in custody since 10.07.2023, charge-sheet has been filed and petitioner is not required for the purpose of investigation, the trial may take a considerable time, therefore, petitioner be enlarged on bail.

Learned Public Prosecutor has opposed the bail application.

Having heard learned counsel for the petitioner, learned public prosecutor as well as counsel for the complainant and perusing the material available on record, considering the nature of allegation against petitioner, charge-sheet has been filed and conclusion of trial may take time, but without commenting on merits of the case, this Court deems it just and proper to release the petitioner on bail.

Accordingly, the bail application is allowed and it is ordered that the accused-petitioner Surendra Kumar @ Kalu S/o Shri Jagram shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
