The present interim bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in judicial custody in connection with F.I.R. No.VII(IO)10/NCB/JZU/2022 of Narcotics Control Bureau, Jodhpur for the offences under Sections 8/15 8/25 & 8/29 of NDPS Act.
Heard representative of the petitioner and the learned P.P. present on behalf of the State. Perused the material available on record.
The instant application has been filed on the ground that the petitioner is suffering from fatty lever and infection therein, as a consequence of which, he is suffering regular pain. This fact is evident from para no.5 of the order impugned wherein it is

mentioned that the jail authorities are taking him to hospital intermittently.
Considering the Sonography and pathology reports and the prescriptions; on humanitarian ground, the temporary bail application filed on behalf of the applicant deserves to be allowed.
Accordingly, misc. interim bail application is allowed. The petitioner shall be released on bail for a period of 30 days from the date of his actual release provided he furnishes a personal bond in the sum of Rs. 50,000/- along with two sound and solvent sureties in the sum of Rs.25,000/- each to the satisfaction of concerned trial court. The order shall be effective from the date of the petitioner's release. The Superintendent of the concerned jail shall give the date of surrender to the petitioner.
