The instant bail applications have been filed under Section 439 Cr.P.C. on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.473/2022, registered at Police Station C.P.S. ACB Jaipur, for the offences under Sections 07, 07 A of Prevention of Corruption (Amendment) Act, 2018 and 120-B of IPC.

Learned counsel for the accused-petitioners submits that the accused-petitioners have been falsely implicated in the case and they are in judicial custody since 14.12.2022. The trial of the case will take sufficiently long time to conclude. Therefore, he prays to enlarge the present accused-petitioners on bail.

Per contra, learned Public Prosecutor opposed the bail application.

Considering the submissions made and looking to the overall facts and circumstances of the case, without commenting on the merits of the case, this court deems it just and proper to enlarge the petitioners on bail.

Accordingly, the present bail applications filed under Section 439 Cr.P.C. are allowed and it is ordered that the accusedpetitioner (1) Bhanwar Nath S/o Lehar Nath and (2) Dau Ram S/o Lt. Chunni Lal arrested in the aforesaid FIR shall be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the learned lower Court for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
