The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.8/2023, registered at Police Station Pindwara, District Sirohi for the offence under Sections 8/15 of NDPS Act, 1985.

Learned counsel for the accused-petitioners submits that the recovery is below commercial quantity. No other cases of similar nature are pending against the accused-petitioners and they are in judicial custody since 05.01.2023. Accused-petitioners have been falsely implicated in the present case, thus, he prays to enlarge the present accused-petitioners on bail.

Per contra, learned Public Prosecutor opposed the bail application.

Considering the overall facts and circumstances of the case, particularly, looking to the facts of the case that the recovery of poppy straw is below commercial quantity and the accusedpetitioners are in judicial custody since 05.01.2023 and are not involved in any other cases of similar nature, without expressing any opinion on merits of the case, this court deems it just and proper to enlarge the petitioners on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner (1) Bhuda Ram S/o Shri Kala and (2) Rana Ram S/o Shri Sangrama Ram arrested in the aforesaid FIR shall be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the learned lower Court for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
