This second bail application has been filed under Section 439 of Cr.P.C. in connection with FIR No.42/2020 registered at Police Station Jhalrapatan, District Jhalawar for the offences under Sections 420 & 406 of IPC.

Learned counsel for the petitioner submits that the petitioner is behind the bars since long and charge-sheet has been filed. As per rejection bail order, the petitioner has no criminal antecedents. Earlier, the petitioner was granted interim bail by this Court vide order dated 02.12.2022. Counsel further submits that now both the parties have settled their dispute amicably. Therefore, looking to the facts and circumstances of the case, the petitioner may kindly be released on bail.

Learned Public Prosecutor has opposed the bail application, whereas, learned counsel for the complainant has submitted that he has no objection if the bail application of the petitioner is granted.

Heard. Perused the material available on record.

Considering the submissions made by learned counsel for the petitioner as well as learned counsel for the complainant and taking into consideration overall facts and circumstances of the case but without expressing any opinion on the merits/demerits of the case, this court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the second bail application under Section 439 of Cr.P.C. is allowed and it is ordered that the petitioner Shabbir Husain S/o Mahmood Husain shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/with two sureties of Rs.25,000/- each (out of which one surety shall be the resident of Jhalawar District) to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
