The instant bail application has been filed by the petitioner under Section 439 Cr.P.C against the order impugned passed by learned court below in connection with FIR No.38/2023 registered at Police Station Kunwariya, District Rajsamand, for the offences under Sections 420, 384, 467, 468, 471 and 120-B of IPC.
Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in this case. It is further submitted that offences are triable by the First Class Magistrate. It is also submitted that co-accused viz. Rajesh Khateek, Kishan Lal, Laluram Bheel, Naveen Gorva, Raju Lal and Dilip Kharol have already been enlarged on bail by this Court vide orders dated 21.04.2023 and 26.04.2023 respectively. long time. Therefore, it is prayed that the accused-petitioner may be enlarged on bail.
Per contra, learned Public Prosecutor has opposed the bail application.
Heard.
Considering the arguments advanced by the counsel for the parties and looking to the overall facts and circumstances of the case, this court deems it just and proper to enlarge the accusedpetitioner on bail.
Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner- Veni Ram S/o Tulsi Ram Bheel shall be enlarged on bail in connection with FIR No.38/2023 registered at Police Station Kunwariya, District Rajsamand, provided he furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
