The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.167/2022 Police Station Sayla, District Jalore for the offences punishable under Sections 498-A, 376(D) and 376(2)(F)(N) of I.P.C.

Learned counsel for the petitioner submits that it is alleged against the petitioner that being father-in-law, he harassed the complainant and raped her. He further submits that due to family dispute, false allegation has been levelled against the petitioner. The FIR is delayed and the trial of the case may take considerable time.

Learned Public Prosecutor opposes the bail application.

I have considered the arguments advanced by learned counsel for the parties and perused the material available on record.

Taking into account the facts and circumstances of the case, without commenting on the merits of the case, this Court deems it just and proper to release the petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner - Pappu Khan S/o Ramjan Khan, shall be enlarged on bail in FIR No.167/2022 Police Station Sayla, District Jalore provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
