The petitioner apprehends arrest in connection with FIR No.503/2019 registered with Police Station Kotwali Alwar, District Alwar for offences under Sections 420, 467, 468 and 471 of IPC.

Factual background of this case is that there was a partnership firm consisting of the family members. The petitioner and her husband under a family settlement separated the firm business on 18.03.2016 and started a separate business in the name and style of Modern Auto Cars Private Limited. The allegation is that on 17.02.2017, husband of the petitioner, who was a co-partner, produced a forged authority letter before the Bank, said to be signed by Alka Gupta, bhabhi of Sanjay Gupta. When the Bank sent a notice for recovery of loan, the aforesaid act of Sanjay Gupta surfaced and FIR was lodged.

Learned counsel for the informant has opposed the bail application on the ground that the petitioner was also co-partner and also actively involved in the act committed by Sanjay Gupta.

Considering the fact that the main allegation is against coaccused Sanjay Gupta, it is directed that the petitioner be released on anticipatory bail.

Accordingly, the instant anticipatory bail application stands allowed. It is directed that in the event of arrest or surrender within two weeks, the petitioner above-named shall be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of like amount with following conditions:-

(i) that the petitioner shall fully cooperate with the investigation / trial of the case;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

¶23

(iii) that the petitioner shall not leave India without prior permission of the Court.
