This application for bail under Section 439 Cr.P.C. has been filed by the petitioner who has been arrested in connection with FIR No.705/2022 registered at Police Station Subhash Nagar, Bhilwara, for offences under Sections 376, 323, 342, 506 and 509 of IPC.

Learned counsel for the petitioner submitted that the prosecutrix is a mature woman. Learned counsel submitted that prosecutrix and petitioner were in consensual relationship from last few years. To substantiate aforesaid contention, attention of the Court was drawn towards various friendly photographs of petitioner and prosecutrix. Drawing attention of the Court towards various Whatsapp chats sent by the prosecutrix to the present petitioner through her mobile No.XXXXXX5351, learned counsel for the petitioner submitted that on turning their relations strained and in order to teach a lesson to the petitioner, the prosecutrix

has foisted a false FIR against him. Learned counsel submitted that the petitioner is in judicial custody, challan has been filed and the trial of the case will take sufficiently long time, therefore, the benefit of bail should be granted to the accused-petitioner.

Per contra, learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the bail application.

Heard learned counsel for the petitioner, learned Public Prosecutor and learned counsel for the complainant. Perused the material available on record.

Having considered the rival submissions, facts and circumstances of the case, without expressing any opinion on merits/demerits of the case, this Court is of the opinion that the bail application filed by the petitioner deserves to be accepted.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner- Irfan Multani S/o Mohammad Umar shall be enlarged on bail in connection with FIR No.705/2022 registered at Police Station Subhash Nagar, Bhilwara, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to so.
