This anticipatory bail application under Section 438 CrPC has been filed by the petitioner against the order dated 15.12.2022 passed by learned Additional Sessions Judge No.1, Rajgarh, District Churu, in Criminal Misc. Case No.104/2022 arising out of FIR No.163/2022 registered at Police Station Sahwa, District Churu for the offences punishable under Sections 458, 323, 307, 427, 382 & 143 of the IPC.
Learned counsel for the petitioner submits that the petitioner has wrongly been entangled in the present case. However, it is submitted on behalf of the petitioner that the petitioner is ready to surrender before the concerned Magistrate, who may consider his bail application on the same day.
Learned Public Prosecutor has opposed the bail application.
Taking into consideration the facts and circumstances of the case, in the interest of justice, it is directed that if the petitioner

surrenders before the learned Magistrate within one week and files a bail application, the learned Magistrate concerned shall consider his bail application preferably on the same day in accordance with law.
The present bail application is disposed of accordingly.
