found that the deceased was not subjected to cruelty for the demand of dowry by any of the family members of the petitioner. Therefore, the case for the said offences was not found proved. During the investigation, it was found that there was a dispute regarding a mobile phone between the deceased and her husband- Subhash Kumar. It has also been submitted that the sister of the petitioner has been married to the complainant- Vijay Pal and sister of Vijay Pal (deceased) was married to the present petitioner. Therefore, there was no question of demand of dowry in the matter. It has been further submitted that on the date of occurrence, the petitioner was not present in the house. The deceased consumed pesticide and committed suicide only on a petty matter of having a mobile phone. The petitioner has not instigated the deceased to commit suicide. It has been further submitted that charge-sheet has been filed against the petitioner only for the offence under Section 306 IPC. He was arrested on 13.12.2022 and since then, he is behind the bars and trial is likely to take long time to conclude. Therefore, looking to the facts and circumstances of the case, the petitioner should be enlarged on regular bail.
