Instant bail applications have been filed by petitioners under Section 439 Cr.P.C. in connection with FIR No.216/2023 registered

at Police Station Singhana, District Jhunjhunu for offence(s) under Sections 387, 307, 120-B IPC and Section 3/25, 5/27 Arms Act. 2. Learned Public Prosecutor submits that information to complainant has already been sent, however no one has put in appearance on behalf of complainant.

Counsel for petitioners submits that petitioners have falsely been implicated in the present case; petitioners are in custody since long and conclusion of trial will take considerable time, therefore, petitioners may be enlarged on bail. 4. Learned Public Prosecutor has opposed the bail applications. 5. Having heard learned counsel for petitioners as well as learned Public Prosecutor and perusing the material available on record; considering the fact that charge-sheet has been filed against the petitioner-Anil @ Sunil for offence under Section 5/25 of Arms Act and as far as petitioner – Rahul @ Sukha is concerned, it is a case of no injury, investigation has been completed and no previous antecedents of petitioner-Rahul; petitioners are in custody since long and conclusion of trial will take considerable time, but without commenting on merits of the case, this Court deems it just and proper to release the petitioners on bail.

Accordingly, bail applications are allowed and it is ordered that accused-petitioners (1) Anil @ Sunil S/o Shri Bannaram and (2) Rahul @ Sukha S/o Jisukhram shall be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before

the court concerned on all the dates of hearing as and when called upon to do so.

However, in view of pendency of cases against the petitionerAnil @ Sunil, it is made clear that if the petitioner is found involved in similar offence, during bail granted by this Court or breach of this condition is reported or come to the notice of the Court, the same shall be a reason for the trial Court to cancel the bail, granted by this Court.
