The present interim bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in judicial custody in connection with F.I.R. No.159/2021, P.S. Sadar, Dist. Chittorgarh for the offences under Sections 8/15 of the NDPS Act and under Section 3/25 of the Arms Act.

Heard representative of the petitioner and the learned P.P. present on behalf of the State. Perused the material available on record. 3. The instant application has been filed on the ground that the wife of the petitioner is pregnant and date of delivery given by the doctor is 04.12.2023 and there is no other family member to look after her, therefore, the temporary bail application filed on behalf of the applicant may be allowed.

Considering the submissions and taking a humanitarian view of the matter, this Court is inclined to grant indulgence of temporary bail to the petitioner to enable him to look after his wife.

Accordingly, the instnat interim bail application is allowed. The petitioner shall be released on bail for a period of 20 days from the date of his actual release provided he furnishes a personal bond in the sum of Rs. 1,00,000/- along with two sound and solvent sureties in the sum of Rs.50,000/- each to the satisfaction of concerned trial court. The order shall be effective from the date of the petitioner's release. The concerned jail authority shall give the date of surrender to the petitioner.
