The petitioner has been arrested in FIR No.13/2017 registered at Police Station Falna for the offences punishable under Sections 8/15, 8/18 of NDPS Act; Sections 3/25, 3/27 of Arms Act; Sections 307, 332, 353, 482, 485 IPC; and Section 66C of I.T. Act. He has preferred this seventh bail application under Section 439 Cr.P.C.

Learned counsel for the petitioner has pointed out that out of total 67 witnesses, 26 witness have been examined. He further submits that the petitioner is in custody since 21.01.2017, which is more than six years.

Learned Public Prosecutor opposes the bail application.

Heard learned counsel for the parties as well as perused the material available on record.

Thus, having regard to the totality of the facts and circumstances of the case and without expressing any opinion on

the merits of the case, this Court deems it just and proper to grant bail to the accused petitioner under Section 439 Cr.P.C.

Accordingly, this seventh bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioner Hanuman Ram S/o Sh. Jaita Ram shall be released on bail in connection with FIR No.13/2017 registered at Police Station Falna provided he executes a personal bond in a sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
