The instant bail application has been filed by the petitioner under Section 439 Cr.P.C. seeking bail in connection with the FIR No.195/2020 registered at Police Station Rajnagar, District Rajsamand, for the offences punishable under Sections 409, 420, 467, 468 and 471 IPC.

Learned counsel for the petitioner further submitted that the offences alleged to have been committed by the petitioner are triable by Magistrate. Learned counsel further submitted that no recovery is due to be effected from the present petitioner. The accused-petitioner is behind the bars since long and the trial of the case will take sufficiently long time to conclude, therefore, the benefit of bail may be granted to the accused-petitioner.

Learned Public Prosecutor has vehemently opposed the bail application and submitted that looking to the seriousness of the accusations, the petitioner does not deserve to be enlarged on bail.

This Court vide order dated 26.09.2023 directed learned Public Prosecutor to procure the case diary from the Investigating Officer.

In compliance of the order dated 26.09.2023, the case diary of the case was produced before this Court for its perusal.

From the case diary, this Court prima facie , finds that the investigation from the the present petitioner has already been complete and as per the Investigating Officer, no recovery is now expected to be made from teh present petitioner. In view of the fact that as per the Investigating Officer, this Court also finds that the offences alleged to be committed by the petitioner are triable by magistrate.

Having considered the rival submissions, facts and circumstances of the case and looking to the possibility that the trial may take long time to conclude, without expressing any opinion on merits/demerits of the case, this Court is inclined to enlarge the petitioner on bail.

Accordingly, the bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioner- Dilip Kumar S/o Babulal Purohit , shall be released on bail in connection with FIR No.195/2020 registered at Police Station Rajnagar, District Rajsamand, provided he executes a personal bond in a sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/each to the satisfaction of learned trial court for his appearance
