The petitioner apprehends arrest in connection with FIR No.01/2023 registered with Police Station PBI Medical and Health Services Rajasthan, Jaipur, District Jaipur for offences under Sections 3, 4, 5, 6, 18, 23, 25 and 29 of PCPNDT Act, 1994 and Sections 2G, 2H, 3, 4 and 9 of PCPNDT Act, 1996 and Section 420 and 120-B of IPC.

Allegation against the petitioner is that he carried some females on his vehicle to the clinic of the co-accused for illegal termination of pregnancy.

Learned counsel for the petitioner submits that when the Police raided the hospital of the co-accused, the co-accused who was a doctor was arrested. Doctor was present there but the petitioner was not there. During investigation someone alleged

that the petitioner was also involved in the act of the doctor. The petitioner has got no criminal antecedent.

Learned Public Prosecutor has opposed the bail application.

Considering the lack of direct material against the petitioner, it is directed that the petitioner be released on anticipatory bail.

Accordingly, the instant anticipatory bail application stands allowed. It is directed that in the event of arrest or surrender within two weeks, the petitioner above-named shall be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of like amount with following conditions:-

(i) that the petitioner shall fully cooperate with the investigation / trial of the case;

¶24

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

¶25

(iii) that the petitioner shall not leave India without prior permission of the Court.
