The petitioner apprehends arrest in connection with FIR No.14/2022 registered with Police Station Suroth, District Karauli for offences under Sections 420, 120, 467, 468 and 471 of IPC.

Claim of the complainant in the FIR is that the land of the complainant bearing Khasra No.1017 was sold in favour of the petitioner through registered sale deed just to put false claim on the property. Later on, the petitioner obtained a patta of change of user of the land from agricultural to residential. The law is well settled that no one can transfer a better title than he himself possess. Hence, act of the accused has not caused any wrongful loss to the complainant, if the complainant is real owner of the property.

Learned counsel for the complainant as well as learned Public Prosecutor have opposed the prayer for bail.

Considering the facts aforesaid, let the petitioner be released on anticipatory bail.

Accordingly, the instant anticipatory bail application stands allowed. It is directed that in the event of arrest or surrender within two weeks, the petitioner above-named shall be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of like amount on following conditions:-

(i) that the petitioner shall fully cooperate with the investigation of the case;

¶22

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

¶23

(iii) that the petitioner shall not leave India without prior permission of the Court.
