The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.130/2021 registered at Police Station Hindumalkot, District Sriganganagar for the offence(s) under Sections 302, 341, 323 and 143 of I.P.C.

Learned counsel for the petitioner submits that false case has been implicated against the present petitioner and the similarly situated co-accused Rajveer, Lokesh, Lalchand and Jasram have already been enlarged on bail vide orders dated 01.02.2023 (Lokesh), 21.07.2022 (Lalchand), 21.12.2022 (Rajveer) and 07.05.2022 (Jasram) by the Co-ordinate Bench of this Court, and the case of the accused petitioner is not distinguishable from other accused petitioners, who have already been enlarged on bail. Therefore, the benefit of grant of bail may be granted to the accused-petitioner.

Per contra, learned counsel for the complainant and learned Public Prosecutor opposes the grant of bail application and state

that the eye-witness, in his statements recorded before the learned trial court, has specifically alleged that accused petitioner Karanveer inflicted the injury resulting into death of the deceased Omprakash and the case of other accused petitioners who were enlarged on bail is distinguishable from the present petitioner. Therefore, his bail application may be dismissed.

Considering the arguments advanced by the counsel for the parties and looking to the overall facts and circumstances of the case that Petitioners Lokesh, Lalchand and Rajveer have already been enlarged on bail and in the statement of Praveen Kumar and Pradeep Kumar, they have stated that the co-accused namely Karanveer, Lokesh and Rajveer have caused injuries to the deceased, I deem it just and proper to enlarge the accusedpetitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Karanveer S/o Lalchand in connection with FIR No.130/2021 registered at Police Station Hindumalkot, District Sriganganagar shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
