The petitioner has been arrested in connection with FIR No. 244/2023 of Police Station – Barmer, District Barmer for the offences punishable under Sections 384, 386, 387, 388, 500, 502, 504 IPC and Section 67, 67A of the IT Act. He has preferred this second bail application under Section 439 Cr.P.C.

The first bail application is dismissed on 25.07.2023 with liberty to file fresh bail application after filing of charge-sheet. 3) Arguing on this second bail application, learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this present case. It is further submitted that the alleged offences are triable by First Class Magistrate. It is also submitted that charge-sheet has already been filed in the matter.

The accused-petitioner is in custody since long and the trial of the case will take long time. Therefore, the benefit of bail should be granted to the accused-petitioner.

Learned Public Prosecutor as well as learned counsel appearing on behalf of complainant have vehemently opposed the bail application. Learned Public Prosecutor also submitted that the petitioner is a habitual offender.

Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the accused petitioner under Section 439 Cr.P.C.

Accordingly, the second bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioner - Sabal Singh S/o Sh. Nepal Singh shall be released on bail in connection with FIR No. 244/2023 of Police Station – Barmer, District Barmer, provided he executes a personal bond in a sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/each to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty.
