The matter comes up for consideration of instant Leave to Appeal filed on behalf of State seeking leave to file appeal against the judgment dated 30.08.2022 passed by the Additional District & Sessions Judge, Merta in Sessions Case No.67/2015, whereby it has acquitted the respondents from the offence under Sections 302, 201 and 34 of IPC.
Having heard learned counsel for the parties and after going through the record of the trial court, we are of the opinion that it is a fit case where leave can be granted to the State for challenging the judgment dated 30.08.2022 passed by the trial court. Hence, this Leave to Appeal is granted. Let memo of Leave to Appeal be treated as memo of Appeal.
