from police control room then he was attacked in furtherance of common intention by respondents no.2 to 4 and was forcefully taken to house of Ashok Kumar wherein he was brutally beaten up with intention to kill him. Thereafter, he was locked in a room and on his call, after arrival of police he was rescued and taken to hospital. He further submitted that from evidence of PW7, the entire incident was proved and the injuries were proved from injury report Ex.P20 and X-ray report P31, exhibited by PW12 Doctor Surendra Meena. He further submitted that PW3 Kanchanbai was eye witness to entire incident and she not only corroborated the story but narrated entire story. He submitted that learned trial court had failed to appreciate aforesaid evidence and only on the basis of surmises and conjectures acquitted respondents no.2 to 4. He further referred the statement of investigating officer and other police officials to submit that after investigation, respondents no.2 to 4 were arrested and during investigation other evidence were also collected from spot, further verified the evidence of PW7. At last he submitted that learned trial court without proper appreciation of evidence of prosecution had drawn a conclusion of acquittal. Further, heavily relied upon evidence of DW1, which is contrary to principle of law.
