On 08.08.2023, learned counsel Mr. Alkesh Agarwal submitted that earlier senior counsel Mr. R.R. Nagori was appearing in the matter and despite telephonic information, the petitioner has not contacted him and therefore, he prayed for time to serve a registered notice on the petitioner.
The counsel has placed on record the notice sent to the petitioner through registered post on 12.08.2023. The track report of the postal department of the said notice has also been placed on record according to which the notice has been delivered. Meaning thereby, it has been served on the petitioner.
Learned counsel for the petitioner submitted that despite registered notice being served, he has received no instructions.
In view of the above facts, it seems that the petitioner has lost interest in the present litigation.
The petition is therefore, dismissed in non prosecution.
