An application has been preferred on behalf of the respondents with the submission that during pendency of the appeal, the respondents have handed over possession of the premises to the appellant on 15.03.2018. On the said possession being handed over, it has been accepted by the appellant that the respondents would now not be liable to make any payments towards mesne profits.
Learned counsel appearing for the appellant admits the above averments and submits that in view of the fact that possession has been handed over by the respondents, he does not want to pursue the present first appeal.
