Learned counsel for the appellant submits that an amicable settlement between the parties have been entered into out of the Court. He, on instructions, seeks permission to withdraw the present appeal.

In view of the submission made, the permission as prayed for is granted.

Accordingly, the present appeal is dismissed as withdrawn.

Learned counsel for the appellant has made a request that the court fee as filed in the present appeal be directed to be refunded.

The request as made seems to be reasonable as the appeal has been withdrawn at the initial stage in terms of a compromise. In view of the same, the court fee paid by the appellant on memorandum of appeal shall be refunded back to the appellant and the certificate in this regard shall be issued by the office.
