The matter comes up on the Misc. Application filed on behalf of the State for seeking clarification of order dated 21.05.2018.

Learned AAG Dr.Ganesh Parihar submitted that this Court while allowing the writ petition filed by the writ petitioners imposed cost of Rs.50,000/- to be recovered from the Erring Officers of the State.

Learned AAG, however, submitted that the Court while allowing the writ petition did not mention the Authority before whom, such cost was required to be paid.

This Court finds that one of the respondents in the writ petition i.e. Celex Technologies Private Limited had filed D.B. Special Appeal (Writ) No.725/2018 (M/s. Celex Technologies Pvt. Ltd. Vs. State of Rajasthan & Ors.) challenging the order passed by the Single Bench and appeal filed by such respondent, was also dismissed by the Division Bench, vide order dated 01.06.2018.

This Court finds that direction to deposit cost by the Erring Officers of the State is required to be complied with and as such, this Court modifies the order dated 21.05.2018 and directs that cost of Rs.50,000/- may be deposited by the State in the office of Rajasthan Legal Services Authority, Jaipur within a period of four weeks.

Accordingly, the present misc. application stands disposed of.
