The petitioner Mr. Ajay Goswami has approached this court by way of this contempt petition raising a grievance that the respondents have blatantly flouted the order dated 06.08.2020 passed by this court in D.B. Civil Writ Petition No.17167/2019 and

that the representation of the petitioner has not been decided as mandated by the order referred to supra.

The petitioner had filed the above writ petition seeking to question legality of the gazette notification dated 18.10.2019 issued by the State Government to the extent the area of Gram Panchayat Kudi Bhagtasani was not included in the newly created Municipal Corporation, Jodhpur.

After hearing the arguments of the petitioner and the learned AAG, this court directed the respondents to consider the grievance raised by the petitioner and to take appropriate decision regarding inclusion of the Gram Panchayat Kudi Bhagtasani in the Municipal Corporation, Jodhpur.

Mr. Sunil Beniwal, learned AAG, has placed on record a copy of the order/communication dated 10.01.2022 issued by the Special Secretary, Local Self Government Department, Government of Rajasthan, Jaipur, as per which, discussions were held and it has been consciously decided not to include the area of Gram Panchayat Kudi Bhagtasani in the Municipal Corporation, Jodhpur. The representation of the petitioner has been rejected.

In this background, we are of the firm view that the order dated 06.08.2020 has been complied with in pith and substance and the respondents cannot be held liable for contempt. Accordingly, leaving the petitioner at liberty to take recourse of suitable remedy for ventilating his grievance, if any, the instant contempt petition is disposed of. The rule is discharged.
