Mr. Kotwani, learned counsel for the petitioner, seeks permission to withdraw the present writ petition with liberty to avail remedy under Clause 22 of Rajasthan Foodgrains and Other Essential Articles (Regulation of Distribution) Order, 1976.

Learned counsel for the petitioner submits that since the suspension of license amounts to violation of fundamental right to carry on trade, the Appellate Authority be directed to decide petitioner’s appeal expeditiously.

In view of the submissions made, permission granted.

The writ petition is dismissed as withdrawn with liberty to the petitioner to file an appeal along with stay application within a period of seven days before the Appellate Authority.

The Appellate Authority shall try to decide the appeal as well as stay application as early as possible, preferably within a period of four weeks on receiving of the same.
