This writ petition, which has been filed assailing the legality and validity of order dated 18.12.2019 passed by Assistant Mining Engineer, Neem Ka Thana, the order dated 14.12.2021 passed by Additional Director (Mines) dismissing the first appeal as also the order dated 05.05.2022 passed by the State Government dismissing the second appeal preferred thereagainst by the

petitioner, is being disposed of in following terms as agreed and requested by the learned counsels for the respective parties:-

“1. The order dated 05.05.2022 passed in appeal No.12/22; Shri Niranjan Sharma Vs. Assistant Additional Director (Mines) and Anr., is quashed and set aside.

The matter is remanded back to the second appellate authority to decide the appeal afresh vide reasoned order dealing with the grounds mentioned in the memo of appeal and submissions, if any, raised by the appellant during the course of personal hearing.”
